Waiver and Liability Agreement

I(hereinafter referred to as “Owner”,

the legal guardian of (hereinafter referred to as “dog(s)”), hereby agree to the following terms and conditions of my dog(s) participation in the activities at K9 Friends Inc. (hereinafter referred to as ‘K9 Friends’):

1. By enrolling the above-named and described dog(s), I represent that I am the legal owner of the named dog(s) and I assume all risks, dangers and responsibility for injuries to the named dog(s). Owner understands and agrees that Owner is solely responsible for any harm to Owner’s dog(s) while Owner’s dog(s) is/are attending K9 Friends.

2. Rendering services (doggy daycare, boarding, grooming and training) to extremely old, chronically ill or otherwise debilitated pets requires extra care, which our caring and trained staff is happy to provide. However, special-needs pets, puppies and senior pets naturally have a higher risk of injury, stress-related illness, or exacerbation of any pre-existing condition. As such, by boarding your special-needs pet, puppy or senior pet with us, you are waiving any claim for injury or illness experienced by your pet while in our care, and that is not directly caused by the negligence or lack of care on the part of our staff.

3. Owner agrees to pay an extra fee of ten dollars ($10.00) per day for administering any and all prescribed medication and five dollars ($5.00) per day for feeding Owner’s dog whilst in the charge of K9 Friends during daycare, boarding and training service.

4. Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. All dog play is monitored by K9 Friends to avoid injury, but scratches, punctures, torn ligaments, and other injuries may occur despite the best supervision. Owner agrees that K9 friends may seek veterinary care for my dog(s) if such care is deemed reasonably necessary for the welfare of my dog(s). K9 Friends agrees that it will make a reasonable effort to contact the Primary and Secondary contacts or Emergency contact(s) prior to seeking veterinarian treatment.

5. All dogs must pass a “2 day doggy daycare trial”, where a general behaviour assessment is done by a professional dog behaviourist and trainer; prior to gaining membership and receiving daycare and/or overnight stay services. This trial is the equivalent of 2 days of the Owner’s dogs’ doggy daycare fee. This trial is mandatory and non-refundable and needs to be settled prior to the arrival of the dog for its assessment. Owner may also be called at ANY GIVEN TIME during the “2 day doggy daycare trial” to come to collect their dog; should the dog prove difficult to handle and/or a danger to itself, K9 Friends staff, K9 Friends dog clientele and human clientele, on site. K9 Friends’ owner and staff reserve the right to refuse services at ANY GIVEN TIME, to any and all parties whose dogs have been determined to not be fit for the environment.

6. No dog may be admitted to doggy daycare that shows signs of any type of aggression. Owner further understands and agrees that in admitting Owner’s dog(s) to K9 Friends, Owner is representing to K9 Friends that Owners’ dog(s) is/are in good physical health and mentally sound; and have not harmed, shown aggression, or exhibited any threatening behaviour towards any person, child, cat or other dog. Any dog demonstrating aggression or other behaviour deemed unacceptable by K9 Friends staff will be quarantined and required to leave K9 Friends immediately. Owner will still be responsible for and agrees to paying daycare any medical bills and/or other daycare/boarding fees in full that are related to dog, whilst dog is on premises and in the care of K9 Friends

7. Owner agrees to pick up their dog within the assigned check-in and check-out windows for all K9 Friends services. A late fee of $20.00 will be charged to Owner for any pick-up after 6 pm. Owner must be in contact with K9 Friends staff via call or text to advise if they are later than their prearranged check-out window. Owner agrees to pay the late fee immediately upon arrival, in cash or via e transfer before the dog is handed over to Owner.

8. Owner agrees to provide K9 Friends with at least 48 hours notice to cancel doggy daycare, overnight stay, and/or training services to avoid being charged for the session. Grooming cancellation requires 24 hours notice to avoid being charged for the session. Exceptions may be made in cases of a dog’s medical issue, with proof provided in the form of a veterinary bill or receipt

9. Owner further understands and agrees that neither K9 Friends nor any of its employees, staff or volunteers, will be liable for any illness, injury, death, and /or escape of Owner’s Dog(s) provided that reasonable care and precautions are followed, and Owner hereby releases all of them of any liability of any kind whatsoever arising from or as a result of Owner’s dog(s) attending or participating at K9 Friends.

10. Owner further understands and agrees that any behavioural or physical health problems that develop with the Owner’s dog(s) while at K9 Friends will be handled and treated as deemed best by the employees, staff and volunteers of K9 Friends, in their sole discretion, and Owner expressly agrees to assume full financial responsibility for any and all expenses arising or relating thereto. This includes aggressive or destructive behaviour.

11. Owner further understands and agrees that Owner’s dog(s) are healthy and will at all times while attending K9 Friends have current vaccinations. We will require documentation of up-to-date vaccination records of dog(s) annually. Owner is not enrolling any dog in K9 Friends that has any condition that could potentially jeopardize the health of other dogs or people and has not had any potentially communicable condition within 30 days prior to enrollment. Owner further understands that even if Owner(s) dog is vaccinated for Bordatella (Kennel Cough) there is a chance that the Owner(s) dog can still contract Kennel Cough. I agree that I will NOT hold K9 Friends responsible if Owner’s dog(s) contracts Kennel Cough.

12. Owner agrees and understands that they must administer regular flea and tick prevention to help ensure their dog remains pest-free while at K9 Friends. Owner also understands that if a dog is found to have fleas or ticks, the owner will be notified for immediate pick-up. For boarding dogs, the emergency contact will be notified for prompt pick-up.

13. Owner further understands and agrees that Owner’s dog(s) is required to be spayed/neutered (after the age of 12 months) to enroll at K9 Friends. Owner understands after the age of 6 months up to 12 months that K9 Friends reserves the right to ask Owner to spay/neuter earlier depending on dog personality/temperament. If Owner refuses, Owner understands K9 Friends reserves the right to refuse any and all services.

14. Owner further understands and agrees that it is the Owner(s) responsibility to leave an adequate supply of food and medications for Owner(s) dog during the entire time Owner’s dog(s) is cared for by K9 Friends. Should the food/medication supply need replacement, I authorize K9 Friends to purchase replacement and Owner will reimburse K9 Friends for the cost plus a $25.00 replacement fee (per occurrence) plus the actual food and medication costs.

15. Owner further understands and agrees that Owner’s dog(s) will have access to a fenced outside area. Owner agrees to assume full liability if Owner’s dog(s) escapes.

16. Owner further understands and agrees that if dog(s) is/are not picked up by the end of the K9 Friends’ business day, then Owner hereby expressly authorizes K9 Friends to take whatever action is deemed necessary for the continuing care of Owner’s dog(s) and Owner agrees and promises to pay to K9 Friends all costs of continuing such care upon demand by K9 Friends. Further, Owner understands that if Owner does not pick up their dog(s) as scheduled, K9 Friends shall be authorized to charge the owner the current late fees required. If K9 Friends staff cannot get in touch with Owner on day of pick-up, Owner agrees to pay boarding rate for every extra day Owner’s dog is still on-site.

17. Owner understands that pre-paid training packages are non-refundable and expire 6 months from the date of purchase. All training fees, whether individual or packages that are coded to clients, must be paid in full prior to services rendered. Boarding fees are due in full prior to the arrival of each dog’s stay. Fees incurred by the end of the dog’s stay (i.e. late charges, medication, food, etc.) must be paid in full before dog(s) is/are given to Owner. For regular dog daycare, invoices are sent out at the beginning of each week. These fees are due and payable at the end of the dog’s last weekly daycare session. Payment may be made by cash or e-transfer to k9friendsdoggydaycare@gmail.com

18. K9 Friends reserves the right to refuse admittance to any dog or to dismiss any dog that does not meet the health, temperament or other K9 Friends standards. The determination shall be made at the sole discretion of K9 Friends’ owners and staff

19. Owner agrees that K9 Friends is not responsible for lost, stolen, or broken items that accompany their dog during its stay

20. Owner understands that their dog(s) must be licensed by their home city. K9 friends will not be responsible for city bylaw infraction tickets and/or fines during walks and/or visits from city bylaw officers. Any fines incurred will be charged to owners upon pickup of dog(s).

21. Owner understands that in order to maintain control and exhibit leadership in a large group of dogs, kenneled and unkenneled, certain humane training and disciplinary methods, along with positive reinforcement and rewards; may be used as K9 friends owners and staff see fit, given the circumstances.

22. PHOTO AND VIDEO RELEASE: Owner agrees to allow K9 friends to use Owners dog’s(s) name(s), image(s) and/or likeness in any form, for use at any time; in any media, marketing, advertising, illustration, trade or promotional materials without compensation; and Owner releases to K9 friends all rights that Owner may possess or claim to such images, likeness or recordings.

23. Communication and correspondence with dog owners, unless it is an emergency; will be limited to K9 Friends business hours during weekdays. Call back hours are between the timings of 8 am and 4 pm, Monday to Friday. K9 friends staff reserve the right to respond to texts, emails, social media messages, voicemails and phone calls when it is convenient and the care giving routines for the dogs are complete. Owners understand it may take up to 72 hours to receive a response (unless it is an emergency) as the care of our dogs is of the utmost importance and K9 Friends staff members’ first priority and responsibility

24. Owner agrees to keep all K9 Friends documents (including but not limited to K9 Friends cyber information package, services and rates, liability waiver and doggy guest form) and K9 Friends correspondence private and confidential

25. Owner agrees to give K9 Friends ten days to take immediate action and resolve any formal complaints or conflict with solutions and action; before taking to social media with a negative review on any online platform. If after ten days of expressing a formal complaint, Owner has not witnessed K9 Friends act or take the aforementioned steps, Owner may leave a negative review online if they wish. K9 Friends is committed to ensuring the utmost clientele experience, for both dogs and Owners alike and is grateful for the given opportunity to do so

26. Owner further understands and expressly agrees that each and every of the foregoing provisions contained in Paragraphs 1 – 26 above shall be in force and effect and shall apply to each and every occasion on which Owner boards or deposits Owner’s dog(s) with K9 Friends for daycare, extended boarding, grooming and/or training; as the case may be. This Agreement shall remain in full force and effect as between the parties until and unless otherwise cancelled or superseded by a writing signed by both parties.
